Kramer Rayson can help businesses understand employment laws in Tennessee, in part by reviewing handbooks and other policies and providing training, but also by consulting with employers on difficult situations with a focus on litigation avoidance when possible. Even more valuable to an employer in establishing that relationship is being advised of defenses that are available to the employer, but only if the employer has adopted a particular policy that is properly written. A recent example is Tennessee’s expansion of the Healthy Workplace Act, which essentially provides immunity for employers for certain causes of action if the employer adopts a written policy addressing abusive conduct/bullying that meets specific requirements.
