“It’s like asking yourself, ‘Do I need a dentist or a doctor?’” says Benjamin T. Barnett, the firm’s founder and chief litigator. “If your situation has gotten to a point that you’re asking yourself if you need an expert to look at it, you’ve already answered your question.”

Clients commonly believe that the best way to handle a case is in the courtroom. While Barnett is an experienced litigator, he believes that the majority of his cases that are resolved out of court (more than 90%) have better results for the client. Barnett says “the firm is here to resolve problems, not to add risk.”

“The art of resolving cases—which is the art of being a good lawyer—is finding the best way to resolve a case that meets your client’s needs.” And in Family Law matters, finding that resolution is no simple feat. “The devil’s in the details is what we say when we mediate cases,” says Barnett. “People can agree on the broad strokes of things, but then when we get to the details, very rarely do they fully agree. It’s our job to help peaceably fill in those details.”

Even if a client sits down with their spouse during a divorce and they can agree to sell their house, that’s not the end of the story, says Barnett. “Do you agree to the realtor? If the house doesn’t sell within a certain number of days, what happens? Who determines the sale price and acceptance of offers?” The list goes on and it is important to have someone in your corner asking those important questions.
